Note on data processing by social media operators

As soon as you access a social media account of the Studierendenwerk Dortmund on a social media platform, the terms and conditions and data processing guidelines of the respective operator apply. The Studierendenwerk Dortmund has no influence on the data processing of the respective social media platform. Information about which data is processed by the social media operator and for what purposes can be found in the privacy policy of the respective operator. You can assert your data protection rights against the social media operator, e.g. the right to information about your stored data. If you have registered on a social media platform and logged in, a cookie will be stored on your PC, via which you can be clearly identified by the social media operator. This enables the social media operator to track all your activities on the social media platform and your path through the internet, for example via websites with "Like" buttons, especially when you click on them. Social media operators can use your profile and behavioural data, for example, to evaluate your habits, personal relationships, preferences, etc. Even if you delete your content (pictures, messages, comments, like actions) or delete your user account, your stored data will remain on the servers of the social media operators. The processing also takes place in countries outside the European Union.

What personal data does the Studierendenwerk Dortmund process and for what purposes? Where does your data come from?

Through our social media accounts, we offer a contemporary opportunity for dialogue. We communicate in particular with the students of the universities for which we are responsible as the Studierendenwerk and at which we are active for the students with our service offers. Studierendenwerk Dortmund processes the content that you provide to us when you use our social media accounts, such as comments, videos, images, likes, messages, etc., as well as the date, time and your user name, depending on the platform. In addition, we process statistical usage data provided to us by the platform operator, such as the times of access, the number of accesses to our account and the regional origin of the accesses; this data is anonymous for us, we cannot assign the data to any individual person. Studierendenwerk Dortmund processes the data for the following purposes: To generate and make available social media content To communicate with users and process enquiries To moderate comments and discussions on posts To evaluate which content is relevant to users and adapt the content accordingly To draw attention to interesting dates and offers of Studierendenwerk Dortmund and to advertise the use of our range of services In addition, we check the communication on our social media accounts with regard to inappropriate content. As far as possible, we determine under which profile a certain content was posted, the timestamp of creation, the user ID, the user name and a reference to other posts. The result of a check can be the deletion or hiding of content or the blocking of a user, as well as the assertion of rights if necessary.

On what legal basis is our data processing based? Is there an obligation to provide data?

The legal basis is Art. 6 para. 1 letter e DSGVO in conjunction with§ 2 Studierendenwerksgesetz NRW for the fulfilment of our legal social mandate for the students, which also includes public relations, information and dialogue about our service offers. Insofar as processing is based on consent, Art. 6 para. 1 letter a DSGVO is the legal basis. Insofar as we have to fulfil legal obligations, data processing is also based on the legal basis Art. 6 (1) letter c DSGVO. In this context, there is no obligation to provide data.

How long will the data be stored?

All data published on the internet and on social media platforms is basically unlimited and freely available. The storage period of personal data within the social media platforms depends on the respective platform operators. The Studierendenwerk Dortmund has no influence on which data is stored by the platform operators and for how long. Insofar as the Studierendenwerk Dortmund processes data, we will only store it for as long as is necessary for the processing purposes and for the documentation and traceability of our activities, or as required by legal retention obligations. Older contributions are deleted on a regular basis. We reserve the right to delete or block data in our social media accounts at any time. If users publish illegal content on the social media accounts of the Studierendenwerk Dortmund, we reserve the right to delete or block this content immediately and, if necessary, to secure it internally in order to enable or carry out legal prosecution.

Who gets your data?

All data published on the social media platforms is generally freely accessible worldwide. Within the Studierendenwerk Dortmund, your data is processed by the employees of the Studierendenwerk Dortmund, whereby only the responsible departments and persons process your data. In addition, we use service providers who are contractually obliged to comply with data protection regulations, in particular to manage our social media accounts and to evaluate the usage that takes place there. In the event that you have given us consent, we will pass on your data in accordance with your consent. Data will be passed on to authorities and public bodies if we are obliged to do so by a legal regulation. Data will also be forwarded if this is necessary for us to enforce legal claims.

What data protection rights do you have?

You have the right to information about the personal data we process about you in accordance with Article 15 of the GDPR. You have the right to rectification pursuant to Article 16 of the GDPR, to erasure pursuant to Article 17 of the GDPR, to restriction of processing pursuant to Article 18 of the GDPR, to revocation of consent pursuant to Article 7 of the GDPR, to objection pursuant to Article 21 of the GDPR and the right to data portability pursuant to Article 20 of the GDPR. Revocation of consent: You can revoke any consent given to us to process your personal data at any time. The revocation is effective for the future. Processing that took place before the revocation is not affected by this. In principle, the revocation can be sent to us without any formalities, but for reasons of proof, we request that you send it to us by post or e-mail with the subject "Revocation", stating your name and address, or hand over a letter. As a precaution, we would like to point out that after you have revoked your consent, we may continue to process your data in whole or in part in a permissible manner if there is another legal basis for doing so. Right to object: You have the right to object at any time to the processing of personal data relating to you if grounds for doing so arise from your particular situation, provided that the processing is based on Article 6(1)(e) or (f) DSGVO. In principle, the objection can be sent to us without any formalities, but for reasons of proof, we request that you send us a letter or e-mail with the subject "Objection", stating your name and address, or hand over a letter. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
